Registration of Powers of Attorney

There is no requirement to register a Power of Attorney, unless the attorney needs to deal with buying or selling property.  In this case, the Power of Attorney document must be registered with the Land and Property Information Division of the NSW Department of Lands.  Many people leave copies of Powers of Attorney documents with their solicitor or bank.  A person who is claiming to act as an attorney should be able to provide you with a certified copy of the Power of Attorney document.

Confirming a Power of Attorney

NSW automatically recognises Enduring Powers of Attorney made in other states.  There is no formal recognition procedure.
